Letecia Stauch is scheduled for a status conference at the EL Paso County Courthouse at 1:30 p.m. MST
It is determined at this hearing that on December 22, 2020 the second competency evaluation will take place at the El Paso County Jail. This was delayed due to a Covid-19 outbreak at the jail.
Judge Werner grants a request for 5 more hours for the 2nd competency evaluation. The request was made because the evaluator needs additional time to go through jail phone calls.
The total hours granted for the 2nd competency evaluation is 35 hours. Download the request and order below under the files section.
After a second competency evaluation was performed Letecia Stauch was determined to be competent to stand trial on her charges in the death of Gannon Stauch.
Letecia is requesting a conflict hearing which means she is wanting a new attourney. She was informed that she would need to submit that request in writing and that if there was a conflict hearing that would be closed to the public.
Interestingly a comment was made about the El Paso County Sheriff requesting increased security after the second evaluation. The just responded with "I understand what you are saying". That is all we know about that at the moment but we are mentioning it here as it may make sense later on.
The preliminary hearing for the case is set to be heard on March 11 & 12 2021.
Letecia Stauch appeared via web with her defense team for a hearing regarding her council. It was a closed door session including only the Judge, the Defense team, and the defendant.
The Judge did not rule instead leaving the ruling to Judge Werner who is presiding over the case. He did however schedule an Argullo Advisement which is a hearing used when a defendant wants to represent themselves.
The Argulio Advisement is a hearing that establishes that the defendant knowingly, competently, and with confidence is representing themselves with the documented evidence of such. It is a hearing that removes the option to use self representation as a reason for appeal.
the hearing is scheduled for:
February 24, 2021 at 3:00 p.m. It is expected to be open to the public.
The preliminary hearing remains scheduled for March 11 & 12 with the 15 as an overflow date.
The next scheduled hearing will be the Preliminary hearing which is scheduled for March 11 & March 12, 2021. Letecia was given more time to prepare for the case which is now scheduled in May 20 of 2021.
There are over 26,000 pages of evidence. Judge Warner ruled that Letecia be provided with the 1800 pages that is considered the case core and that she get photos of the tangible evidence.
Judge Werner appointed Caitlin Kreck as criminal investigator for Leticia. His order does not explain his decision however it would be reasonable for her to have an investigator to help her navigate the legal documents she has on her case.
Below is a letter submitted to Judge Werner that outlines the reasons Letecia believes she needs to represent herself. She talks about collusion with her former defense and the prosecution. She describes mental illness however her competency has already been determined with 2 separate evaluations.
