On Saturday February 27, 2021 in the early morning hours about 3:00 a.m., Brittany Gosney, age 29, loaded up the 3 of 4 children of hers that she had custody of into their Dodge Minivan and drove to Rush Run Park in Preble County Ohio. She was familiar with the spot as she along with her boyfriend had taken her children fishing there in the past.
She then unloaded all 3 children from her van with the intent of abandoning them in the park area. The children are age 9, 7, and 6. Little 6 year old James grabbed onto the door handle to get back into the car at which time Brittany sped away dragging him and possibly even running him over. She then left the scene.
She returned a short while later and found James still in the roadway deceased. She then loaded his body along with her 2 remaining children back into the van and went home. James's body was stored near a window in a spare bedroom.
The next night Sunday Feb 28, 2021 in the morning hours also about 3:00 .a.m. Brittany drove with her boyfriend James Hamilton, to the Interstate 275 bridge near Lawrenceburg and dropped his body off the bridge into the Ohio River.
They reported James as a missing child on Sunday Feb 26, 2021 at about 10:16 a.m. The officers were suspicious of the story told from the beginning. By 10:00 pm both James Hamilton and Brittany Gosney would be booked on charges into the Middletown City Jail. Brittany would confess to the killing of James and state that her Boyfriend was pressuring her to get rid of the kids.
James's father would later come out and state all she had to do was give James to him.
In March 2, 2021 a search warrant was executed on the home where they lived.
The search for his remains continues.
On March 8, 2021 Brittney Gosney plead not guilty to the charges against her related to James. Her boyfriend, James Hamilton also pled not guilty.
A jury trial date for Gosney and Hamilton was set for Monday, May 24, at 8:30 a.m. with a pre-trial set for Monday, March 22, at 8:30 a.m.
She is being held on a million dollar bond. At a recent hearing she entered a plea of not guilty by reason of insanity.
This plea prompted the judge to order a competency hearing in her case. Her defense attorneys also raised a concern about her ability to assist in her defense. They stated in court that:
"Defendant struggles to assist in her defense and counsel has serious concerns regarding defendant's mental health."
